Michigan law treats the illegal distribution of prescription drugs the same way as it does for cocaine or heroin dealing. A conviction for the distribution of prescription drugs will likely result in jail or prison time.
In the event you have been previously convicted on drug-related charges, or are accused of distribution in select public places including schools, you could be subject to additional penalties like driver’s license suspension. Forging a prescription form can result in serious criminal penalties as well, as harsh as actual possession or distribution drug crime charges.
In certain cases, however, Michigan law does allow drug charges to be taken under advisement and dismissed. Under MCL 333.7411, Michigan law allows an individual who has never been charged with possession of narcotics to have their case taken under advisement and dismissed upon successful probation. Often, it is our strategy is to convince the court that our client should be placed in this type of alternative sentencing program. By having your drug case taken under advisement, you avoid having a felony drug record, as well as licensing sanctions.
When it comes to defending yourself, every second matters. It’s the accused vs. a vast network of law enforcement and prosecution professionals.
